As far as the constitution of India is concerned, it has been provided in it that each wing of the administration should function within the jurisdiction prescribed by the constitution. The legislative shall be passing he laws, the executive shall be operating upon the law and the judiciary shall be supervising and seeing that the spirit of the constitution is maintained and no wing i.e. the legislative and the executing are not crossing the limits prescribed. Since the legislative is an elected body, they are supreme, but since they themselves have framed the constitution and they are bound to obey the provision of the constitution and at no stage they shall be crossing the limits prescribed.

As far as India is concerned, here we had been successful in maintaining the limits and there had been no controversy. But of late some cases have come to light where the legislative and the judiciary are not maintaining the spirit of the constitution. The judiciary can say that here and there the legislative could not follow the spirit of the provisions of the constitution and they declare the law passed by the legislative as null and void. The legislative is not tolerating this activism of the judiciary and they are again passing laws which are over ruling the judiciary. The law framed by the legislative shall stand supreme.
Time has come when the legislative should take guidance from the legal people before they pass the law and actually notify the same in the official gazette. The legislative has already got a team of legal people with them. Actually these legal people prepare the written document and that is placed before the legislative for formal discussion and formal approval. The people who draft the law keep in their mind the provisions of the constitution and they are not ignoring the constitution because they know that if the law fails, they shall be having adverse remarks from the elected members of the house. The political people give broad lines of the law they desire and it is for the people who are drafting the law to see that the law shall not be crossing the limits prescribed by the constitution. In very rare cases a law is passed which is in controversy with the provisions of the constitution. That is the reason very few cases had been there where the judiciary had to say that the legislative had gone beyond the limits. Most of the laws framed by the legislative in India had been accepted by the judiciary as correct and there had been no comments. Though at some stages the judiciary had to say that the executive had not been operating upon the law framed and adopted properly. The judiciary has got the power to see that the executive is not operating upon the law properly and they can give direction and that direction must be accepted as final. But the judiciary must see and keep in mind that they should not intervene in the sphere of the legislative because they are not the law makers, but they are the interpreter of law framed by the constitution. In a democracy, the people who are elected and who are passing the laws for the country are supreme and the judiciary could come forward to guide them only on those points and limits where the legislative are not maintaining the constitutional law in their mind. The constitution of India is the supreme document which shall be governing all the wings in India and if need be, the legislative should first of all go to the amendment in the constitution and only then they should go through some new law which is not falling within the scope of the present provisions of the constitution. If the legislative wants to declare that whole land in India belongs to the state and it can be taken over from the present occupier without paying him any compensation, then this law shall be going beyond the provisions of the constitution and therefore, the state shall have to amend the constitution first and only then the state shall be able to pass such a law through the legislative. In such violations, the judiciary shall have to come forward and say that the law framed by the legislative is crossing the limits and hence it is null and void.

The limits prescribed in the constitution are in the mind of the judiciary and therefore, they themselves have come forward and they are trying to see that they shall be keeping in mind the spirit of the constitution and at no stage they shall enter into the jurisdiction of the legislative. We must congratulate the judiciary of India who are strictly following the provisions of the constitution and they are vigilant that they should not over power all the wings.
